Man charged with murder after elderly man dies from injuries one month earlier

A man already in jail has been charged with murder after a 93-year-old man he allegedly punched and kicked died ofhis injuries, police said.

Damian Kay Kay Jimenez, 24, is now charged with murder in the death of Guadalupe Andrew Martinez. He had been jailed on charges of unlawful carrying of a weapon, injury to elderly, and evading arrest or detention. Bail was set totaling $581,400.

On Aug. 16, Martinez was using a walker outside an East Side convenience store when Jimenez punched and kicked him in his face and head, an arrest warrant affidavit states. The store was not identified.

Martinez was knocked unconscious and had a severe head laceration. The incident was captured by a security camera and the store owner identified Jimenez to police as a former employee.

Martinez died on Sept. 20 at the Las Colinas of Westover Hills Rehabilitation Center, investigators said.

On Dec. 8, the Bexar County Medical Examiner’s Office ruled Martinez’s death a homicide as a result of blunt force trauma.
