Texas fertility clinic accused of using wrong sperm in IVF procedure

A Texas mother is claiming in a new lawsuit that her children are not biologically related to her husband due to a Fort Worth fertility clinic’s error. Camille and Derrick Bryan, who live in Wise County, claim that Fort Worth Fertility used the wrong sperm twice in their in vitro fertilization procedures, the Fort Worth Star-Telegram reports

The Bryans say that they had two successful fertilized embryo transfers in 2016 and 2018 after Camille had her embryos harvested by Dr. Robert Kaufmann and her husband donated sperm. The couple decided to get a DNA test in August 2022 after their pediatrician noticed a birthmark on the Bryans’ son that is common in children of Asian decent, Tommy Hastings, their attorney, told the Star-Telegram. 

The Bryans do not have any Asian heritage, Hastings said, and DNA test determined that Derrick was not the father of both children. The Bryans filed the lawsuit on February 8.

In total, the Bryans are suing six defendants, including Kaufmann, saying that they “recklessly, negligently, or intentionally mishandled the sperm and allowed an unknown donor to be used to fertilize Camille’s eggs.” They are seeking an unknown amount of damages. 

The Star-Telegram also reports that Kaufmann is being sued by another former patient who claims that he left a foreign object inside her after surgery to reverse tubal ligation.
