New Braunfels man charged with assaulting police officer at state park

Todd was parked in the day-use area of the park, but didn’t have a valid entrance permit placed on his vehicle’s windshield. A “strong odor”of marijuana was coming from the car, according to the report. As Todd made his way back to his parked car, the officer informed him that he needed to pay the park entrance fee and then requested Todd’s identification.

The officer reportedly could smell alcohol on Todd’s breath. After several calm requests for his identification and getting a fake name and birth date, Todd attempted to drive away in his car, according to the report. The park officer then attempted to get him on the ground, but a struggle ensued.

“I commanded the subject multiple times to get on the ground and told him that he was detained,” the officer said in the report. “During the struggle, the subject was able to place me in a headlock. I felt the subject’s arm wrap around my neck.”

After the tussle, Todd was pepper sprayed as he closed his door and drove away. The officer called in the man fleeing the scene to Comal County dispatch. He then drove about two miles and found Todd at the Guadalupe River State Park entrance, the officer drew his gun and Todd got out of his car and laid on the ground, according to the Herald-Zeitung report.

The park officer searched Todd’s vehicle after he was apprehended and found “hand rolled marijuana joints, rolling papers, several opened and unopened cans of hard cider,” according to the report. 

Todd was booked at the Comal County Jail and was charged with assaulting a peace officer, evading arrest with a vehicle, and resisting arrest, according to the report. Todd was later released on a $38,000 bond.
